An Act changing the term of the elected office of moderator in the town of Holden.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Section 4 of the charter of the town of Holden, on file in the office of the archivist of the commonwealth as provided by section 12 of chapter 43B of the General Laws, is hereby amended by striking out the first sentence and inserting in place thereof the following two sentences: At the first annual town election following acceptance of this act, and annually thereafter, the registered voters shall continue to elect selectmen, district school committee and trustees of Damon Memorial. The registered voters shall elect a moderator to serve a term of three years and, unless otherwise provided by by-law, the moderator shall continue to appoint a finance committee and board of appeals.

SECTION 2. Notwithstanding section 1, upon the effective date of this act the elected incumbent moderator of the town of Holden shall serve in that capacity for a period of time equivalent to the remainder of the elected term or sooner resignation, retirement or removal. Thereafter, the elected moderator shall be entitled to serve for a three-year term, pursuant to section 1.

SECTION 3. This act shall take effect upon its passage.
