To the Honorable Senate and House of Representatives,
Pursuant to Article LVI, as amended by Article XC, Section 3 of the Amendments to the Constitution of the Commonwealth of Massachusetts, I am returning to you for amendment H.3912, entitled “An Act Increasing the Membership of the Board of Health of the Town of Marblehead from 3 to 5 Members.”
This Home Rule bill would expand the Board of Health in the Town of Marblehead from 3 to 5 members. I have been informed that it was the intention of the Town to have the newly expanded Board of Health annually elect its own chair from among its members. However, there appears to be a typographical error in the last sentence of section 1 of the legislation, which refers to the “select board” rather than the “board of health” annually electing a chair of the board from among its members. Local boards of health play a vital role in keeping our communities safe and healthy. I support the proposed expansion of the Marblehead Board of Health and request your prompt consideration of this bill.
For the reasons stated above, I recommend that the bill be amended by striking out the word “select” in the last sentence of section 1.
