An Act to exclude uncertified offshore wind companies from receiving Massachusetts Offshore Wind Industry Investment Trust Fund expenditures.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Section 9A, Chapter 23J, subsection (d) of the General Laws, as so appearing in the 2022 Official Edition, is hereby amended by striking out the following in clause (ii):- “the recipient is an offshore wind company or offshore wind organization; provided, that an offshore wind company that has not been certified pursuant to section 8A shall not receive an award in an amount greater than $5,000,000;”  and inserting in place thereof the following words:- “the recipient is an offshore wind company certified pursuant to section 8A or offshore wind organization;”.
