An Act relative to labeling food from mRNA-treated animals and aquaculture.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
Chapter 94 of the General Laws is hereby amended by adding the following section:-
Section 330. (a) As used in this section, unless the context clearly requires otherwise, the following terms shall have the following meanings:
“Aquaculture”, the culture or husbandry of marine organisms by any person.
“food or food products”, any agricultural, horticultural, forest or other product of the soil or water that has been grown, harvested or produced wholly within the commonwealth. Such products shall include: fruits, vegetables, eggs, dairy products, meat and meat products, poultry and poultry products, fish and fish products, grain and grain products, honey, nuts, preserves, maple sap products, apple cider, fruit juice, ornamental or vegetable plants, nursery products, flowers, firewood, fermented agricultural products and Christmas trees.
“Livestock”, cattle, equines, goats, members of the genus Lama, rabbits, sheep and swine.
“mRNA vaccine material”, a substance included in a vaccine to stimulate the production of antibodies and provide immunity against disease by introducing messenger ribonucleic acid that corresponds to a viral protein.
“Poultry”, all domesticated birds.
(b) A label shall be placed on a food or food product offered for sale in the commonwealth derived from aquaculture, livestock or poultry that received mRNA vaccine material.
(c) The label shall: (i) contain a clear and concise statement that the food or food product contains mRNA vaccine material; and (ii) be conspicuously and prominently placed in order to be easily seen by the consumer.
(d) The department of public health may conduct examinations and investigations of food or food products to ensure compliance with this section. If the department finds that a food or food product is not properly labeled as required by this section, the department shall order the stop of sales of the food or food product until it is labeled in accordance with this section.
(e) The department of public health shall promulgate regulations, pursuant to chapter 30A, implementing this section.
