An Act authorizing the transfer of certain parcels of land in the town of Weston from the Weston conservation commission to the select board.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. (a) Notwithstanding any general or special law to the contrary, the conservation commission of the Town of Weston may transfer the care, custody, management and control of the portions of the town-owned land described in subsection (b), which are currently held by the conservation commission for purposes including, but not limited to, passive recreation, open space and conservation purposes, to the select board of the town of Weston for purposes of the siting of water tanks.
(b) The portions of land authorized to be transferred pursuant to subsection (a) consist of (i) a 55,235 square foot parcel, shown as “Parcel A” on a plan entitled “Approval Not Required Plan Paines Hill Tank Water Supply Land,” dated September 25, 2024, and being a portion of the town-owned land identified on the town of Weston assessor’s map 31-6-30 and described in a deed recorded with the Middlesex south registry of deeds in book 13093, page 604; (ii) a 74,841 square foot parcel, shown as “Parcel A” on a plan entitled “Approval Not Required Plan Cat Rock Tank Water Supply Land,” dated September 25, 2024, and being a portion of the town-owned land identified on the town of Weston assessor’s map 14-6 and described in a deed recorded with the Middlesex south registry of deeds in book 9040, page 366; and (iii) a 65,999 square foot parcel, shown as “Parcel A” on a plan entitled “Approval Not Required Plan Doublet Hill Tank Water Supply Land,” dated September 25, 2024, and being a portion of the town-owned land identified on the town of Weston assessor’s map 40-37 and described in a deed recorded with the Middlesex south registry of deeds in book 12355, page 279.
SECTION 2. (a) Notwithstanding any general or special law to the contrary, as mitigation for the transfer authorized in section 1, the select board of the town of Weston shall transfer the care, custody, management and control of the town-owned parcel of land described in subsection (b) to the conservation commission of the town of Weston to be held for passive recreation, open space and conservation purposes pursuant to section 8C of chapter 40 of the General Laws and the protections of Article XCVII of the Amendments to the Constitution of the Commonwealth.
(b) The town-owned parcel of land to be transferred pursuant to subsection (a) as mitigation for the transfers authorized in section 1: (i) contains 217,804 square feet; (ii) is a portion of the town-owned parcel of land identified on the town of Weston assessor’s map 32-23-20; (iii) is described in a deed recorded with the Middlesex south registry of deeds in book 67393, page 247 and book 68039, page 75; and (iv) is shown as “Parcel B” on a plan entitled “Lot 9A Concept Subdivision,“ dated November 1, 2024.
SECTION 3. This act shall take effect upon passage.
