An Act establishing a community public safety improvements fund.

 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

 SECTION 1. Chapter 29 of the General Laws is hereby amended by inserting after section 2PPPPPP the following section:-

 Section 2QQQQQQ. (a) There shall be established and set up on the books of the commonwealth a separate, non-budgeted special revenue fund known as the Public Safety Building Assistance Fund, which shall be administered by the secretary of public safety and security.

 (b) There shall be credited to the fund: (i) all surcharge amounts collected pursuant to paragraph (7) of subsection (A) of section 3 of chapter 90C; (ii) appropriations or other money authorized or transferred by the general court and specifically designated to be credited to the fund; (iii) funds from public and private sources, including, but not limited to, gifts, grants and donations; and (iv) any interest earned on money in the fund.

 (c) Amounts credited to the fund may be expended without further appropriation by the secretary of public safety and security to assist municipalities with the construction, upgrades and other capital needs for public safety buildings, which may include fire stations, police stations and public works buildings. No expenditure made from the fund shall cause the fund to be in deficit at any point.

 SECTION 2. Subsection (A) of section 3 of chapter 90C of the General Laws is hereby amended by adding the following paragraph:-

 (7) There shall be a 10 per cent administrative surcharge on all citations issued pursuant to this subsection. The surcharge shall be deposited into the Public Safety Building Assistance Fund established in section 2QQQQQQ of chapter 29. The dispersal of the funds under the surcharge shall be made to the community in which the ticket was written from with exception to tickets written by the Massachusetts State Police in that community.
