An Act relative to host community agreements.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Notwithstanding any general or special law to the contrary, the model host community agreement template, drafted and developed by the cannabis control commission pursuant to chapter 180 of the acts of 2022, shall be a mandatory agreement between any business entity certified and recorded with the secretary of the Commonwealth applying for a commission license, or business entity currently holding a license issued by the cannabis control commission, and the municipality in which the licensee is located within or plans to locate within.
SECTION 2. A municipality may formally present amendments to a host community agreement before the cannabis control commission and business entity. No more than 30 days after receiving any presented amendments, the cannabis control commission shall submit in writing whether the presented amendments shall be included in the final host community agreement.
SECTION 3. Nothing in this act shall prevent the cannabis control commission from being authorized to review, regulate, enforce, and approve host community agreements, and to make periodic amendments to the model agreement. Provided, however, that the commission shall make any revisions to the model agreement publicly available online.
