SECTION 1.  Chapter 124 of the acts of 2008 is hereby repealed and, notwithstanding any general or special law to the contrary, the North Carver Water District is hereby dissolved.

SECTION 2. Notwithstanding any general or special law to the contrary, without further conveyance or other action, all the assets, liabilities, obligations and indebtedness and the powers and duties of the North Carver Water District including, but not limited to, those enumerated in chapter 124 of the acts of 2008, are hereby transferred to the town of Carver; provided, however, that real property transferred pursuant to this act shall continue to be used for water supply purposes.  The town of Carver may: (i) supply the area formerly defined as the district service area with water for the extinguishment of fires and for domestic and other purposes; (ii) establish fountains and hydrants and relocate and discontinue the same; (iii) regulate the use of such water and fix and collect rates to be paid therefor; (iv) assess and raise taxes for the payment of such services and for defraying the necessary expenses of operating a public water supply, subject to all general or special laws relating to municipal water supply services unless otherwise provided in this act.

SECTION 3. All members of the North Carver Water District commission serving prior to the effective date of this act shall immediately transfer all files, records and materials including, but not limited to, legal and financial records and other materials belonging to the North Carver Water District to the select board of the town of Carver.

SECTION 4. The board of water commissioners of the North Carver Water District is hereby abolished and the tenure of any incumbent members of the board shall terminate. The powers, duties and responsibilities of the board of water commissioners shall pass to the select board of the town of Carver and the director of operations for the town of Carver, respectively, who shall exercise authority and operation of the water system in accordance with this act and all general and special laws relative thereto.

SECTION 6. This act shall take effect upon its passage.
