Chapter 268 of the General Laws is hereby amended by adding the following new section:-
Section 41. Whoever, having been ordered to wear a GPS tracking device by a court of the Commonwealth or by another Court of competent jurisdiction, as part of a condition of probation or as a condition of pre-trial release, and who intentionally damages, removes, modifies or deactivates said GPS tracking device, or who attempts to damage, remove, modify or deactivate said GPS tracking device, shall be punished by imprisonment by no more than five years or incarceration in the House of Correction by not more than two-and-one half years.
