An Act ensuring senior care organization quality and accountability.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
Subsection (e) of section 9D of chapter 118E of the General Laws, as appearing in the 2022 Official Edition, is hereby amended by adding the following new paragraph:-
(7) In contracting with a nursing home licensed under section 71 of chapter 111, any MassHealth senior care options program with which the department or division contracts to provide and coordinate services on a capitated basis shall reimburse the nursing home for care and services provided to a MassHealth member at an amount not less than the current applicable Medicaid fee-for-service payment rate established under 101 CMR 206; provided, however, that such reimbursement payments shall include room and board and all rate add-ons specified pursuant to 101 CMR 206 for the purposes of ensuring access to critical services and facilitating transitions from hospitals to nursing facilities.
