An Act authorizing the Montague Center Fire District and the Turners Falls Fire District to continue the membership of members John Annear, Lawrence William Peters Jr., David Rehorka, Richard Sawin and Sallie Sawin.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Notwithstanding any general or special law to the contrary, David Rehorka, member of the Montague Center Fire District, John Annear, member of the Montague Center Fire District and the Turners Falls Fire District, and Richard Sawin, Lawrence William Peters Jr. and Sallie Sawin, members of the Turners Falls Fire District, may continue serving in their positions until they reach 72 years of age or the date of their retirement or non-reappointment, whichever occurs first; provided, however, that they are mentally and physically capable of performing the duties of their position.
SECTION 2. The Prudential Committee of the Montague Center Fire District may, at the district’s expense, require that David Rehorka and John Annear be examined annually by a physician designated by the district to determine their physical and mental capability to perform the duties of their position.
SECTION 3. The Prudential Committee of the Turners Falls Fire District may, at the district’s expense, require that John Annear, Richard Sawin, Lawrence William Peters Jr. and Sallie Sawin be examined annually by a physician designated by the district to determine their physical and mental capability to perform the duties of their position.
SECTION 4. No further deductions shall be made from the regular compensation of John Annear, Richard Sawin, Lawrence William Peters Jr., David Rehorka and Sallie Sawin pursuant to chapter 32 of the general laws subsequent to their reaching the age of 65 in connection with their service to the district for retirement or pension purposes.
SECTION 5. This act shall take effect upon its passage.
