Howitt for legislation to prohibit the Massachusetts Bay Transportation Authority from authorizing free access to passenger service to retirees or employees not in the performance of official duties.  Transportation.

An Act prohibiting free ridership on the MBTA.
 

              Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

              Section 1.  Chapter 161, as most recently amended by chapter 25 of the acts of 2009, is hereby amended by inserting at the end thereof the following new section:-

              Section 49. Notwithstanding any general or special law to the contrary, nothing in this chapter shall be construed as to permit the board to authorize any agreement that designates employees, except in the performance of their official duties, or retirees as “free riders” with access to passenger service at no cost.

              Section 2.  Notwithstanding any general or special law to the contrary, the authority shall cease to provide passenger service at no cost to any employee, except in the performance of his or her official duty, retiree, member of the board, or member of the retirement board.
