August 24, 2009

To the Honorable Senate and House of Representatives:

Pursuant to the provisions of Article II, Section 8, Paragraph 1, Clause (2) of the Amendments to the Constitution, as amended by Article LXXXIX, I am filing for your consideration the attached legislation entitled, “An Act Validating The Town of Sherborn’s Annual Town Election Held On May 12, 2009.”

Senator Brown, Representative Linsky , and the Sherborn Board of Selectmen have asked that this legislation be filed to validate the town’s annual election held on May 12, 2009.  The town lacks authority to proceed in matters authorized by the town election, including obtaining bond money for certain projects.  Accordingly, absent this legislation the town would be required to hold a costly special election.

To save the town of Sherborn from the expense of conducting another election, I urge your early and favorable consideration of this bill.

                                                                                    Respectfully submitted,

                                                 DEVAL L. PATRICK,

                                                              Governor.
