Message from His Excellency the Governor recommending legislation relative to An Act Relating To An Issue Of Bonds By The Town Of Belmont.

State House  ·   Boston 02133

December 8, 2009

To the Honorable Senate and House of Representatives:

Pursuant to the provisions of Article II, Section 8, Paragraph 1, Clause (2) of the Amendments to the Constitution, as amended by Article LXXXIX, I am filing for your consideration the attached legislation entitled, “An Act Relating To An Issue Of Bonds By The Town Of Belmont.”

Senator Tolman, Representative Brownsberger and the Belmont board of selectmen have requested that I file this legislation to ratify, validate and confirm the vote of the town of Belmont at its June 3, 2009 town meeting.  The vote concerns a matter of great concern to the community: the construction of a new elementary school.  Absent this bill, the town would have to expend a significant amount of money to fund a special election, which would further strain the town’s budget in these difficult economic times.

Accordingly, I urge your early and favorable consideration of this bill.

                                                                                    Respectfully submitted,

                                                 DEVAL L. PATRICK,

The Commonwealth of Massachusetts

In the Year Two Thousand and Nine

An Act Relating To An Issue Of Bonds By The Town Of Belmont.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

The vote of the Town of Belmont passed June 3, 2009 appropriating and authorizing a borrowing of $39,764,430 for the design and construction of a new Wellington Elementary School, located at 121 Orchard Street, is hereby ratified, validated and confirmed in all respects and the amounts required to pay for any bonds or notes issued pursuant to such vote shall be exempt from the limitation on total taxes imposed by section 21C of chapter 59 of the General Laws notwithstanding any discrepancy in the descriptions of the purpose of such borrowing authorization contained in the June 3, 2009 vote and the vote of the town passed at the June 8, 2009 special town election.

SECTION 2.   This act shall take effect upon its passage.
