An Act a uthorizing the t own of Chelmsford to c onvey c ertain c onservation l and and e asements.


 

              Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.   Notwithstanding the provisions of any general or special law to the contrary and pursuant to the provisions of Article 97 of the Amendments to the Constitution of the Commonwealth of Massachusetts, the t own of Chelmsford is hereby authorized to transfer an d convey to the Chelmsford Water District, for water supply purposes, a parcel of land shown as “Parcel W” on a plan entitled "Approval Not Required Plan, Map 102, Lots 357-6, 357-8 and 357-14," dated July 31, 2009, prepared by Meisner Brem Corporation, co ntaining 4.17 acres, more or less, according to said plan, and a permanent, non-exclusive access and utility easement over a 40-foot wide right-of-way shown as "Easement Area A" and "Easement Area B" on said plan, with such easement areas remaining under t he care, custody and control of the Chelmsford Conservation Commission , said Parcel W and the easement areas comprising a portion of land conveyed to the town of Chelmsford by deed recorded with the Middlesex North District Registry of Deeds in Book 2329 , Page 302, and held by the Chelmsford Conservation Commission for conservation and passive recreational purposes , on such terms and conditions, and for such consideration, including nominal consideration, as the Board of Selectmen may deem appropriate .

SEC TION 2.   In consideration for t he transfer and conveyance of the land and the easements in S ection 1 of this act, the Chelmsford Water District shall transfer and convey to the town of Chelmsford, acting by and through its Conservation Commission, for cons ervation and passive recreational purposes, the parcel s of land shown as “ Open Space Parcel A” and “Open Space Parcel B ” on a plan entitled “Hillside Lane Extension ‘Definitive Plan’ for Subdivision in Chelmsford, MA,” dated July 1, 1993, revised through F ebruary 11, 1994, recorded with the Middlesex North District Registry of Deeds in Book 186, Page 1 , containing in total 4.43 acres, more or less , according to said plan, and a permanent non-exclusive access and utility easement over the 40-foot wide right- of-way shown on said plan as "Reservoir Road (40' width - Paper Street)", which easement area shall remain under the care, custody, and control of the Chelmsford Water District, said parcels and easement area being described in a deed recorded with the Mid dlesex North District Registry of Deeds in Book 7184, Page 183.

              SECTION 3.   This act shall take effect upon passage.
