An Act relative to a certain alcoholic beverages license in the town of Dracut.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1.   Section 1 of chapter 88 of the acts of 2005 is hereby amended by striking out the last sentence.

SECTION 2.   Said chapter 88 is hereby further amended by inserting after section 1, the following section:-

Section 1A.   The licensing authority shall not approve the transfer of the license to any other location.  The license may be granted by the licensing authority at the same location if an applicant files with the authority a letter in writing from the department of revenue indicating that said license is in good standing with the department and that any and all applicable taxes have been paid.

If the license granted under this act is cancelled, revoked or nor longer in use, it shall be returned physically with all legal rights, privileges and restrictions pertaining thereto to the licensing authority.  Notwithstanding section 17 of chapter 138 of the General Laws, the licensing authority may grant the license to a new applicant at the same location under the same conditions as specified above.

SECTION 3.   This act shall take effect upon its passage.
