A N A CT AUTHORIZING THE TOWN OF WAREHAM TO ISSUE EIGHT (8) ADDITIONAL

LIQUOR LICENSES

 

 

Be it enacted by the Senate and House of Representatives in General Court assembled,

      And by the authority of the same, as follows:


              SECTION 1. Section 2 of chapter 424 of the a cts of 2006 is hereby amended by adding the following words:- and 8 licenses to adjacent parcels of land on Map 109A , lots 1 t o 9, inclusive, 1017A, 1018A, 1019, 1020A, 1020B, 1021, 1022, 1 023A, 1023B, 1024A, 1024B 1024C and 1038 .

              SECTION 2 .   (a) Notwithstanding section 17 of chapter 138 of the Gen eral Laws or any other General or special law or rule or regulation to the contrary, the licensing authority of the town of Wareham may grant 1 additional license for the sale of all alcoholic beverages to be drunk on the premises under s ection 12 of said c hapter 138 to Hadley-MacIntosh Enterprises, Inc. d/b/a The Stonebridge, located at 5 East b oulevard in the Onset section of said town . A license granted under this section shall be subject to all of said c hapter 138 except said s ection 17.

              (b)   Once issued, t he licensing authority shall not approve the transfer of the license issued under this section to any other location , but it may grant the license to a new applicant at the same location if the applicant files with the authority a letter from the d epartment of r evenue indicating that the license is in good standing with the d epartment and that all applicable taxes have been paid.

              (c) If the license granted under this section is cancelled, revoked or longer in use, it shall license shall be returned physically, with all of the legal rights, privileges and restrictions pertaining thereto, to the licensing authority which may then grant the license to a new applicant at the same location under the same condition s as specified in this section .  

              SECTION 3 .     (a)   Notwithstanding section 17 of chapter 138 of the General Laws or any other General or special law or rule or regulation to the contrary, the licensing authority of the town of Wareham may grant 1 additional license for the sale of all alcoholic beverages to be drunk on the premises under s ection 12 of said c hapter 138 to Captain Als Restaurant LLC d/b/a/ Captain Al’s, located at 3236 Cranberry h ighway in the Onset section of said town . A license granted under this section shall be subject to all of said c hapter 138 except said s ection 17.

              (b)   Once issued, t he licensing authority shall not approve the transfer of the license issued under this section to any other location , but it may grant the license to a new applicant at the same location if the applicant files with the authority a letter from the d epartment of r evenue indicating that the license is in good standing with the d epartment and that all applicable taxes have been paid.

              (c) If the license granted under this section is cancelled, revoked or longer in use, it shall license shall be returned physically, with all of the legal rights, privileges and restrictions pertaining thereto, to the licensing authority which may then grant the license to a new applicant at the same location under the same condition s as specified in this section .  

SECTION 4 .     (a)   Notwithstanding section 17 of chapter 138 of the General Laws or any other General or special law or rule or regulation to the contrary, the licensing authority of the town of Wareham may grant 1 additional license for the sale of all alcoholic beverages to be drunk on the premises under s ection 12 of said c hapter 138 to Grady MacKay’s Village Eatery and Bar located at 330 Main s treet . A license granted under this section shall be subject to all of said c hapter 138 except said s ection 17.

              (b)   Once issued, t he licensing authority shall not approve the transfer of the license to any other location , but it may grant the license to a new applicant at the same location if the applicant files with the authority a letter from the d epartment of r evenue indicating that the license is in good standing with the d epartment and that all applicable taxes have been paid.

              (c) If the license granted under this section is cancelled, revoked or longer in use, it shall license shall be returned physically, with all of the legal rights, privileges and restrictions pertaining thereto, to the licensing authority which may then grant the license to a new applicant at the same location under the same condition s as specified in this section .  

SECTION 5 .     (a)   Notwithstanding section 17 of chapter 138 of the General Laws or any other General or special law or rule or regulation to the contrary, the licensing authority of the town of Wareham may grant 1 additional license for the sale of all alcoholic beverages to be drunk on the premises under s ection 12 of said c hapter 138 to Mark, Incorporated d/b/a China Garden, located at 265 Marion r oad . A license granted under this section shall be subject to all of said c hapter 138 except said s ection 17.

              (b)   Once issued, t he licensing authority shall not approve the transfer of the license to any other location , but it may grant the license to a new applicant at the same location if the applicant files with the authority a letter from the d epartment of r evenue indicating that the license is in good standing with the d epartment and that all applicable taxes have been paid.

              (c) If the license granted under this section is cancelled, revoked or longer in use, it shall license shall be returned physically, with all of the legal rights, privileges and restrictions pertaining thereto, to the licensing authority which may then grant the license to a new applicant at the same location under the same condition s as specified in this section .  

              SECTION 6 .     (a)   Notwithstanding section 17 of chapter 138 of the General Laws or any other General or special law or rule or regulation to the contrary, the licensing authority of the town of Wareham may grant 1 additional license for the sale of all alcoholic beverages to be drunk on the premises under s ection 12 of said c hapter 138 to Tsika, Inc. d/b/a Minerva Pizza, located at 257 Main s treet . A license granted under this section shall be subject to all of said c hapter 138 except said s ection 17.

              (b) Once issued, t he licensing authority shall not approve the transfer of the license to any other location , but it may grant the license to a new applicant at the same location if the applicant files with the authority a letter from the d epartment of r evenue indicating that the license is in good standing with the d epartment and that all applicable taxes have been paid.

              (c) If the license granted under this section is cancelled, revoked or longer in use, it shall license shall be returned physically, with all of the legal rights, privileges and restrictions pertaining thereto, to the licensing authority which may then grant the license to a new applicant at the same location under the same condition s as specified in this section .  

              SECTION 7 .     (a)   Notwithstanding section 17 of chapter 138 of the General Laws or any other General or special law or rule or regulation to the contrary, the licensing authority of the town of Wareham may grant 1 additional license for the sale of all alcoholic beverages to be drunk on the premises under s ection 12 of said c hapter 138  to Rosebrook Place Hospitality LLC, a subsidiary of A.D. Makepeace Company, located at the interchange of interstate highway route 195 and state highway route 25 in said town . A license granted under this section shall be subject to all of said c hapter 138 except said s ection 17.

              (b)   Once issued, t he licensing authority shall not approve the transfer of the license to any other location , but it may grant the license to a new applicant at the same location if the applicant files with the authority a letter from the d epartment of r evenue indicating that the license is in good standing with the d epartment and that all applicable taxes have been paid .

(c) If the license granted under this section is cancelled, revoked or longer in use, it shall license shall be returned physically, with all of the legal rights, privileges and restrictions pertaining thereto, to the licensing authority which may then grant the license to a new applicant at the same location under the same condition s as specified in this section .  

              SECTION 8 .     (a)   Notwithstanding section 17 of chapter 138 of the General Laws or any other General or special law or rule or regulation to the contrary, the licensing authority of the town of Wareham may grant 1 additional license for the sale of all alcoholic beverages to be drunk on the premises under s ection 12 of said c hapter 138 to W/S Wareham Properties LLC d/b/a Wareham Crossing Restaur ant, located at 2421 Cranberry h ighway . A license granted under this section shall be subject to all of said c hapter 138 except said s ection 17.

              (b)   Once issued, t he licensing authority shall not approve the transfer of the license to any other location , but it may grant the license to a new applicant at the same location if the applicant files with the authority a letter from the d epartment of r evenue indicating that the license is in good standing with the d epartment and that all applicable taxes have been paid.

              (c) If the license granted under this section is cancelled, revoked or longer in use, it shall license shall be returned physically, with all of the legal rights, privileges and restrictions pertaining thereto, to the licensing authority which may then grant the license to a new applicant at the same location under the same condition s as specified in this section .  

              SECTION 9 .     (a)   Notwithstanding Section 17 of chapter 138 of the General Laws or any other General or special law or rule or regulation to the contrary, the licensing authority of the town of Wareham may grant 1 additional license for the sale of all alcoholic beverages to be drunk on the premises under s ection 12 of said c hapter 138 to Al & El Corporation d/b/a Ella’s Woodburning Oven Restaurant, located at 31 3 6 Cranberry h ighway in the East Wareham section of said town . A license granted under this section shall be subject to all of said c hapter 138 except said s ection 17.

              (b)   Once issued, t he licensing authority shall not approve the transfer of the license to any other location , but it may grant the license to a new applicant at the same location if the applicant files with the authority a letter from the d epartment of r evenue indicating that the license is in good standing with the d epartment and that all applicable taxes have been paid.

              (c) If the license granted under this section is cancelled, revoked or longer in use, it shall license shall be returned physically, with all of the legal rights, privileges and restrictions pertaining thereto, to the licensing authority which may then grant the license to a new applicant at the same location under the same condition s as specified in this section .  

              SECTION 10 .     This act shall take effect upon its passage.
