Amendment #592 to H3400

[Sponsors] Representative Balser of Newton moves to amend H3400 by adding at the end the following section:

 

SECTION XX.  Section 1 of  chapter 176J of the General Laws, as  most recently amended by section 20 of chapter 288 of the Acts of 2010, is hereby amended by striking out the definition of “Eligible individual” and inserting in place thereof the following definition:-

 

“Eligible individual,” an individual who is a resident of the commonwealth and who is not seeking individual coverage to replace an employment-based health plan for which the individual is eligible, which provides coverage that is at least actuarially equivalent to minimum creditable coverage, and for which the employer contributes at least 33 percent of the cost of the employee’s health insurance; provided, however, that any person enrolled in an individual health benefit plan on or before August 10, 2010 shall be considered an eligible individual so long as such person continues to be a resident of the commonwealth and maintains enrollment in such individual health benefit plan.
