[Sponsors] Mr. Walsh of Boston and Representatives Walsh of Lynn, Strauss of Mattapoisett, Garlick of Needham, Brownsberger of Belmont, Sciortino of Medford, Provost of Somerville, Murphy of Weymouth, Forry of Boston, Michlewitz of Boston, Basile of Boston, Honan of Boston, Collins of Boston, and Ashe of Longmeadow moves to amend the bill by inserting, after section xx, the following new section:
Section 6 of Chapter 118E of the General Laws, as appearing in the 2010 Official Edition is hereby amended by inserting, at the end thereof the following new paragraph:-
The office of Medicaid shall establish a pilot program focused on lowering the cost of procuring opiod analgesics through the use of supplemental rebate agreements. The office of Medicaid shall establish a list of opiod drugs currently being purchased and which are branded and do not have a generic alternative available for purchase. The office of Medicaid shall request supplemental rebate agreements from the manufacturers of such drugs and shall enter into said agreements when savings can be realized. The office of Medicaid shall make a report to the house and senate committees on health care financing and to the house and senate committees on ways and means no later than September 1 of each year on the previous state fiscal year’s activities. The report shall include, but not be limited to, the names of the qualifying drugs, a list of supplemental rebate agreements received and the terms of such, a list of supplemental rebate agreements reached with manufacturers, savings achieved over current expenditures. Any savings achieved through the use of supplemental rebate agreements or other means shall be credited to the Substance Abuse Treatment and Prevention Fund, established under Section 2BBBB of Chapter 29 of the General Laws.
