Preserving Housing Priorities – Technical Correction

[Sponsors] Ms. Fox of Boston, and Representatives Provost of Somerville, Sciortino of Medford, Madden of Nantucket, Forry of Boston, O'Day of West Boylston, Henriquez of Boston, Devers of Lawrence, and Holmes of Boston move to amend the bill in item 7004-0099 in section 2 by striking out the words “and provided further, that the department shall, not later than September 1, 2011, reaffirm regulations clarifying that a household that otherwise qualifies for any preference or priority for state subsidized housing or rental assistance based on homeless or at-risk status shall retain that preference or priority notwithstanding receipt of rental assistance that is intended to be temporary including, but not limited to, any temporary or bridge subsidies provided with state or federal funds”

 

and inserting in place thereof the following words: -

 

and provided further, that the department shall, on or before September 1, 2011, revise its  regulations clarifying that a household that otherwise qualifies for any preference or priority for state subsidized housing or rental assistance based on homeless or at-risk status shall retain that preference or priority notwithstanding receipt of rental assistance that is intended to be temporary to make this protection (1) effective during and after fiscal year 2012, (2) applicable to any such priorities for federally subsidized housing or rental assistance administered by the state or by local housing authorities to the maximum extent not preempted by federal law, and (3) applicable to any and all rental assistance that is intended to be temporary, without limitation as to funding source and including housing assistance funded through item 7004-0108;
