Amendment #724 to H3400

CPCS -  Cost for Transcripts

[Sponsors] Representative Khan of Newton, Provost of Somerville, Ferguson of Holden and O'Day of West Boylsston  move the bill be amended in SECTION 67, in lines 954 to 957, by striking “.If requested by any party, the stenographer shall furnish an electronic reproduction at an amount not to exceed $5 for each electronic reproduction requested.  All electronic reproductions shall be in an open source format as specified by the office of transcription services.  Additional paper copies, if so requested by an indigent person or counsel for an indigent person, shall be paid at 10 cents per page.”  and inserting in place thereof the following:

“; provided, however, that he shall be paid not more than ten cents per page for each additional paper copy ordered at the same time by an indigent party and provided further that he  shall furnish, without additional fee, an electronic reproduction of the transcript to an indigent party upon request.  The indigent party shall not be charged for CD-ROMs from whatever source.  All electronic reproductions shall be in an open source format as specified by the Office of Transcription Services (OTS).

Said SECTION 67 is hereby further amended by striking in lines 959 to 962, inclusive, “provided that, if requested by any party, the stenographer shall furnish an electronic reproduction at an amount not to exceed $5 for each electronic reproduction.  Additional paper copies, if so requested by an indigent person or counsel for an indigent person, shall be paid at 10 cents per page.”  and inserting in place thereof the following:

provided, however, that where an indigent party requests  such transcript the rate shall be not more than ten cents per page for each additional paper copy; and provided further that the stenographer shall furnish , without additional fee, an electronic reproduction of the transcript to an indigent party upon request.  The indigent party shall not be charged for CD-ROMs from whatever source.
