Consolidated Amendment "A" to H3400

Mental Health and Disability Services

Fiscal Note: $1,400,000

 

Amendments from the Mental Health and Disability Services: 87, 92, 105, 136, 137, 159, 186, 196, 200, 214, 240, 263, 264, 299, 336, 397, 406, 421, 585, 597, 614, 628, 629, 637, 639, 679, 686, 702, 704, 713, 727, 735, 738 and 747.

 

Mr. Dempsey of Haverhill and others move to amend H.3400 in section 2, in item 0940-0101, by striking out the figure "1,930,054" and inserting in place thereof the figure "2,030,380".

 

And further amend the bill in section 2, in line item 4110-1000, in line 4, by inserting after the word “network” the following: “provided further that $50,000 be expended for assistive technologies,” and in said line item by striking out the figure “$3,861,398” and inserting in place thereof the figure “$3,911,398”.

 

And further amend the bill in section 2, in item 4120-4000, by inserting after the word “services” the following: “provided further that $50,000 be expended for assistive technologies,” and in said line item by striking out the figure “$10,900,074” and inserting in place thereof the figure “$10,950,074”.

 

And further amend the bill in section 2, in item 4125-0100, in line 2, by inserting after the word “hearing” the following: “provided further that $50,000 be expended for assistive technologies,” and in said line item by striking out the figure “$4,960,393” and inserting in place thereof the figure “$5,010,393”.

 

And further amend the bill in section 2, in line item 5047-0001 by striking the figure “34,122,197” and inserting in place thereof the figure “35,122,197”.

 

And further amend the bill, in section 2, in item 5046-0000, in line 6, by inserting after the word “facilities” the words: “provided further, that the Department of Mental Health is authorized to utilize one time trust fund  monies in an amount not greater than $5,558,637, to expand community services, provided that said services shall include, but not be limited to, residential, clinical and support services to appropriately discharge an adult to the community and to provide them with services necessary to manage their illness and support recovery; provided further, that of said trust fund monies, $558,637 shall be expended on clubhouse services; provided further, that said funds shall not be expended until the department of mental health submits a report to the house and senate committees on ways and means and the joint committee on mental health and substance abuse services detailing the number of individuals to be discharged, the facilities from which they will be discharged and the specific community based services that will be developed to assist them in the community provided further, that  the same level of funding be expended in fiscal year 2012 as expended in the prior fiscal year for jail diversion programs in municipalities that provide equal matching funds from other public or private sources.”

 

And further amend the bill in section 2, in item 5055-0000, by adding the following: “; provided, that funds may be expended for Juvenile Court Clinics”.

 

And further amend the bill in section 2, in item 5095-0015 in line 21 by inserting after the word “facilities” the following words:-  ; provided further, that the department shall file a report with the secretary of administration and finance and the chairs of the house and senate committees on ways on or before December 31, 2011, detailing the procedure, implementation and timing for the closure of any existing inpatient hospital beds and shall include a determination of the capacity in the inpatient public mental health system to effectively and appropriately meet the needs of individuals suffering from mental illness and whether individuals are receiving timely access to state hospital beds.

 

And  further  move that the bill be amended in Section 2 in item 5920-3010, in lines 5 and 6 by striking “the amount authorized in fiscal year 2011” and inserting in place thereof the figure “$3,000,000”; and in said item, in line 32, by inserting after “department” the following: “and provided further, that the department shall submit copies of any amended waiver to the house and senate committees on ways and means, the joint committee on education and the joint committee on children, families and persons with disabilities upon submission of the amendment”; and in said item by striking out the figure “$4,121,177” and inserting in place thereof the figure “$4,621,177”.

 

And further amend the bill in section 2, in item 5930-1000, by inserting on the last line after the words “ICF/MRs” the following:- provided, that the department shall report on all efforts to comply with the provisions of the Olmstead decision, the enhancement of care within available resources to clients served by the department and the steps taken to consolidate or close intermittent care facilities for the mentally retarded, in this item called ICF/MRs, provided further, that the department shall submit a progress report to the joint committee on children, families and persons with disabilities and the house and senate committees on ways and means on such initiatives by December 1, 2011, including both past actions and proposed future actions;

 

And further move to amend the bill, by adding the following section:

 

SECTION XX. Notwithstanding any general or special law to the contrary, the executive office of administration and finance shall report on fiscal year 2011 expenditures for communication access services including, but not limited to, American Sign Language, Computer Communication Access Realtime translation, and Braille from all agencies in the executive branch.  The report shall be submitted to the house and senate ways and means committees on or before December 31, 2011, and shall include the number of people served, month of services and cost per month.
