Mr. Dempsey of Haverhill and others move to amend H.3400 in section 2, in line item 2200-0100, by striking out the figure “$21,532,305” and inserting in place thereof the figure: “$22,932,305”.

And further amend the bill in section 2 by inserting after item 2200-0102 the following item:

2200-0107 For recycling and related purposes consistent with the recycling plan of the solid waste master plan which includes municipal equipment, a municipal recycling incentive program, recycled product procurement, guaranteed annual tonnage assistance, recycling transfer stations, source reduction and technical assistance, consumer education and participation campaign, municipal household hazardous waste program, the recycling loan program, research and development, recycling market development and recycling business development and the operation of the Springfield materials recycling facility; provided, that funds may be expended for a recycling industry reimbursement program pursuant to section 241 of chapter 43 of the acts of 1997………………………$275,000.

And further amend the bill in section 2 by striking out item 2210-0105 and inserting in place thereof the following item:

2210-0105 The department of environmental protection may expend for the administration and implementation of the Massachusetts Toxics Use Reduction Act under chapter 21I of the General Laws an amount not to exceed $3,052,627 from the revenue collected from fees, penalties, grants and tuition under said chapter 21I; provided, that not less than $1,629,860 from this item shall be made available for the operation of the Toxics Use Reduction Institute program at the University of Massachusetts at Lowell; provided further, that the department shall enter into an interagency service agreement with the University of Massachusetts to make such funding available for this purpose; provided further, that not less than $644,096 from this item shall be made available for toxics use reduction technical assistance and technology in accordance with said chapter 21I; provided further, that the department shall submit a report to the house and senate committees on ways and means not later than February 1, 2011 detailing the status of the department's progress in meeting the statutory and regulatory deadlines associated with said chapter 21I and detailing the number of full-time equivalent positions assigned to various implementation requirements of said chapter 21I; provided further, that the department shall enter into an interagency service agreement with the executive office of energy and environmental affairs to make such funding available for this purpose; and provided further, that notwithstanding any general or special law to the contrary, for the purpose of accommodating timing discrepancies between the receipt of revenues and related expenditures, the department may incur expenses and the comptroller may certify for payment the amounts not to exceed the lower of this authorization or the most recent revenue estimate as reported in the state accounting system………………$3,052,627.

 

And further amend the bill in section 2, in item 2300-0100 by adding the following: “; provided further, that the department shall file a report with the secretary of administration and finance, the chairs of the house and senate committee on ways and means, the chairs of the joint committee on environment, natural resources and agriculture on or before April 30, 2012, detailing a plan for a long term funding solution for issues pertaining to repairs and maintenance of dams throughout the commonwealth; and provider further, that the report shall include, but not be limited too, the feasibility of a revolving loan program and utilization of seaport bonds.

And further amend the bill in section 2, in line item 2300-0101, by striking out the figure “$350,000” and inserting in place thereof the figure “410,000”.

And further amend the bill in section 2, in line item 2310-0200, by striking out the figure “$9,400,019” and inserting in place thereof the figure “$9,900,019”.

And further amend the bill in section 2 by inserting after item 2310-0200 the following item:

“2310-0300 For the operation of the natural heritage and endangered species program…..$150,000”.

And further amend the bill in section 2, in line item 2511-0100, by inserting after the words “development and fairs” the following words: “provided, that no less than $200,000 shall be expended to enhance the buy local effort in western, central, northeastern and southern Massachusetts” and in said line item by striking out the figure “4,100,108” and by inserting in place thereof the following figure “4,400,108”.

And further amend the bill in section 2, in item 2800-0100 by adding the following: “; provided further, that the department shall file a report with the secretary of administration and finance, the chairs of the house and senate committee on ways and means, the chairs of the joint committee on environment, natural resources and agriculture on or before April 30, 2012, detailing a plan for a long term funding solution for issues pertaining to repairs and maintenance of seawalls throughout the commonwealth; and provider further, that the report shall include, but not be limited too, the feasibility of a revolving loan program and utilization of seaport bonds.

And further amend the bill in section 2, in line item 2800-0100, by inserting after the words “February 15, 2012” the following words “provided further, that funds shall be expended for the cleanup of Pilayella algae;”.

And further amend the bill in section 2, in line item 2800-0101, by inserting after the words “General Laws” the following words “; provided further, that the department shall continue to make payments pursuant to chapter 307 of the acts of 1987 for the use of certain land;” and in said line item by striking out the figure “$475,008” and inserting in place thereof the figure “$1,002,565”.

And further amend the bill in section 2, in line item 2810-0100, by striking out the figure “40,850,075” and inserting in place thereof the figure “41,550,075”.

And further amend the bill by adding the following sections:

Section XX: Section 7(a) of chapter 236 of the acts of 1988 is hereby amended by adding at the end of the fourth sentence the following:-

; provided, however, that any monies or interest thereon received by the Trust Fund pursuant to section 287 of chapter 110 of the acts of 1993 may be subject to appropriation if a report of the monies received and expenditures funded by such receipts is not filed with the clerks of the House and Senate on or before December 31 of each year.

SECTION XX.  Section 114 of chapter 169 of the Acts of 2008 is hereby amended by

 

striking out the number "2011" and inserting in place thereof the following number:- 2016.
