DRIVER’S LICENSE REQUIREMENTS

Messrs. Tarr, Knapik and Hedlund moved that the proposed new text be amended by inserting, after section ___, the following new sections:-

“SECTION __.  Section 8 of said chapter 90, as so appearing, is hereby amended by striking the third and fourth sentences of the first paragraph, in lines 16 through 22, inclusive, and inserting in place thereof the following:-

Each applicant shall submit with his application a birth, baptismal or school certificate or such other satisfactory evidence of his age as the registrar may require, along with proof of lawful immigration status.  If the registrar has reasonable cause to suspect that any document presented by an applicant as proof of identity, age or immigration status is altered, false or otherwise invalid, the registrar shall refuse to grant the license until the registrar is satisfied as to the applicant’s true identity, age and lawful immigration status.

SECTION __.  Section 8B of said chapter 90, as so appearing, is hereby amended by striking the second and third sentences of the first paragraph, in lines 5 through 11, inclusive, and inserting in place thereof the following:-

Each applicant shall submit with his application a birth, baptismal or school certificate or such other satisfactory evidence of his age as the registrar may require, along with proof of lawful immigration status.  If the registrar has reasonable cause to suspect that any document presented by an applicant as proof of identity, age or immigration status is altered, false or otherwise invalid, the registrar shall refuse to grant the permit until the registrar is satisfied as to the applicant’s true identity, age and immigration status.

SECTION __.  Section 6 of chapter 90F of the General Laws, as appearing in the 2010 Official Edition, is hereby amended by striking the first sentence in its entirety and inserting in place thereof the following:-

No person may be issued a license to operate a commercial motor vehicle unless that person is a resident of the commonwealth, has provided the registry of motor vehicles with proof of lawful immigration status, and has passed a knowledge and skills test for driving a commercial motor vehicle which complies with minimum federal standards established by federal regulation enumerated in 49 CFR part 383, sub-parts G and A, and has satisfied all other requirements of the CMVSA-86 (Title XII of Public Law 99.570) in addition to any other requirements imposed by law.

SECTION __.  Section 16 of chapter 119A of the General Laws, as appearing in the 2010 Official Edition, is hereby amended, in subsection (2), by striking the first sentence and inserting in place thereof the following:-

(2) Every licensing authority shall collect and maintain certain information, including the name, date of birth, address, social security number and immigration status, for each applicant for a license and each individual to whom a license is granted or renewed.

SECTION__.  The registrar shall, within 60 days of the effective date of this act, report back to the clerk of the senate and the clerk of the house of representatives, the joint committee on transportation, and the house and senate committees on ways and means with further recommendations detailing how the registry of motor vehicles can prevent individuals who lack legal immigration status from obtaining a driver’s license.”
