License Suspension for Refusing to Submit to a Breath Test

Ms. Clark and Messrs. Finegold and Downing moved that the proposed new text be amended by inserting, after section ___, the following new section:-

SECTION 1:  Subsection (1)(d) of section 24 of chapter 90, as appearing in the 2010 Official Edition, is hereby amended in line 453 by inserting after the words “nolo contendere” the following:- “ or admits to a finding of sufficient facts of operating a motor vehicle while under the influence of intoxicating liquor, marijuana, narcotic drugs, depressants or stimulant substances, all as defined by section 1 of Chapter 94C”.

SECTION 2: Said section 24 of Chapter 90, as so appearing, is hereby amended in subsection (f)(1) in line 529  by inserting after the words “a court of any other jurisdiction” the following:- “ or assigned to an alcohol or controlled substance education, treatment, or rehabilitation program by a court of the commonwealth or any other jurisdiction for a like offense”.
