Amendment #3 to H3382

Open Road Tolling

Mr. Walsh of Boston moves to amend the bill by inserting the following new sections at the end thereof:

 

SECTION ###.  Notwithstanding any general or special rule to the contrary, the department of transportation shall not implement any open road tolling (ORT) or free-flow tolling that shall lead to the immediate displacement of existing personnel without first offering to train such employees for newly created positions available in the department under any open road or free-flow tolling system.  The department shall give any such employees so trained preference in hiring into such newly created positions in the order of their seniority and shall continue to recognize as their collective bargaining representative the union representing them prior to the implementation of open road or free-flow tolling.

 

SECTION ####. Notwithstanding any general or special rule to the contrary, employees within the toll division of the department of transportation who are displaced by the implementation of open road tolling or free flow tolling shall be entitled to retire under an early retirement program in which such employees will be allowed to add either five years to their age or five years to their years of service for purposes of their eligibility for retirement and for the calculation of their retirement benefits.
