Amendment #437 to H3400

Ethanol C

Representatives Reinstein of Revere, O'Flaherty of Chelsea, Basile of Boston, Toomey of Cambridge, Hecht of Watertown and Provost of Somerville move to amend the bill by adding the following section:

 

"SECTION X. Notwithstanding any general law or special law, or rule or regulation to the contrary, any entity transporting ethanol by rail must finance the purchase of alcohol resistant foam and associated equipment necessary for deployment in all municipalities and immediately adjacent municipalities through which the train cars carrying ethanol could pass.  Any entity transporting ethanol by rail must finance training for all fire department personnel and increased staffing levels in municipalities and immediately adjacent municipalities through which the train cars carrying ethanol could pass.  All trucks and other motor vehicles transporting ethanol to and from a facility that receives, stores, blends or distributes ethanol must meet United States Environmental Protection Agency emissions standards for new vehicles in effect in 2007 or later for their respective classes of vehicles or have diesel emission control technology that removes at least 85 percent of particulates from the exhaust stream.  Such technology shall be verified by the United States Environmental Protection Agency or the California Air Resources Board to achieve reductions in particulate matter emissions at the highest classification level for diesel emission".
