Emergency Assistance, Family Shelter- Imminent Risk

Representatives Khan of Newton, Malia of Boston, Devers of Lawrence, Koczera of New Bedford, Farley-Bouvier of Pittsfield, Kocot of Northampton, Hecht of Watertown, Balser of Newton, O'Day of West Boylston, Canavan of Brockton, Swan of Springfield, Walsh of Boston, Kaufman of Lexington, Provost of Somerville, Smizik of Brookline, McMurtry of Dedham, Toomey of Cambridge, Forry of Boston, Fox of Boston, Sciortino of Medford, Garballey of Arlington, Decker of Cambridge, Madden of Nantucket, Diehl of Whitman, Gordon of Bedford, Rogers of Cambridge, Gregoire of Marlborough, Andrews of Orange, Brady of Brockton, Cronin of Easton and Sannicandro of Ashland move to amend the bill in section 2, item 7004-0101, in line 24-30, by striking out the following: “(d) families who are in a housing situation where they are not the primary lease holder or who are in a housing situation not meant for human habitation and where there is a substantial health and safety risk to the family that is likely to result in significant harm should the family remain in such housing situation; provided further, that the health and safety risk shall be determined by the department of children and families through risk assessments;” and inserting in place thereof the following: “(d) families who are in a housing situation where they are not the primary lease holder or who are in or at imminent risk of being in a housing situation not meant for human habitation and where there is or would be a substantial health and safety risk to the family that is likely to result in significant harm should the family remain in or enter such housing situation; provided further, that the health and safety risk shall be determined by the department of children and families through risk assessments; provided further, that families who have stayed in three or more housing situations within the past 30 days or have spent one or more nights in an emergency shelter situation not funded by this item and who can no longer stay in any of said housing or emergency shelter situations shall be deemed to be in a housing situation not meant for human habitation where there is a substantial health and safety risk to the family that is likely to result in significant harm should the family remain in such housing situation pursuant to subsection (d) of this item;”
