Amendment #605 to H3400

DMH Community Services

Representatives Balser of Newton and Malia of Boston move to amend the bill in section 2 by inserting after line item 5095-0015 the following item:

5095-0017      For the department of mental health, in further compliance with the decision in Olmstead v. L.C. 527 U.S. 581, to enhance care for clients served by the department, and to provide community services for individuals in department facilities who are ready for discharge; provided that the department shall identify individuals in its inpatient facilities who would be ready for discharge if there were adequate community services available to support such individuals in community settings; provided further that the department may allocate funds from this item to items 5046-0000 and 5095-0015 as necessary to so identify such patients and to develop community services permit them to be discharged; provided further that the department shall discharge such individuals in accordance with clinical assessment and the exercise of professional judgment; provided further that the department shall on or before March 1, 2014, submit a report to the house and senate committees on ways and means and the joint committee on mental health and substance abuse detailing the services provided in this line item, the number of individuals discharged pursuant hereto, and the projected services and number of individuals to be discharged before June 30, 2014. …………………………………… $10,000,000.
