Amendment #608 to H3400

Health Information Payment Reform Amendment

Mr. Walsh of Lynn moves to amend the bill by adding the following section:

"Section XXXX

Section 6D of chapter 40J of the General Laws, as most recently amended by Section 38 of Chapter 224 of the Acts of 2012, is hereby amended by adding the following sentence at the end of subsection (a):

“The corporation and the institute shall also maintain responsibility for fulfilling the obligations under the Office of the National Coordinator Challenge Grant and HIE Cooperative Agreement.”

Said Section 6D is hereby further amended by inserting the following language at the end of the last sentence in subsection (d):

“except for those contracts entered into by the corporation that the institute deems necessary to implement its responsibilities under the Office of the National Coordinator Challenge Grant and HIE Cooperative Agreement or in conjunction with any grants or other funding authorized under subsection (e) of this section 6D or loan arrangements authorized under section 6E ½ of this chapter.”

Chapter 118I of the General Laws, as added by Section 134 of Chapter 224 of the Acts of 2012, is hereby amended by deleting all of the language in subsection (b) of section 3 that appears after the phrase “health records systems” in clause (iii).

Said Chapter 118I is hereby further amended by deleting the last sentence of section 10.".
