Determination of Need

Miss Gregoire of Marlborough moves to amend the bill by inserting after SECTION 103 the following section:-

SECTION XX. Section 25C of chapter 111, of the General Laws, as amended by chapter 224 of the acts of 2012, is hereby further amended by inserting after subsection (n), the following subsection:-

(o) The Department shall not issue any determination of need unless it has first received a report from the health policy commission that the project is not likely to result in a significant impact on the commonwealth’s ability to meet the health care cost benchmark or on the competitive market.  Any notice of intent or application for determination of need filed with the department also shall be filed with the Health Policy Commission on the same day.  The department, in making any determination of need, shall incorporate the cost and market impact review to be conducted by the health policy commission under section 13 of chapter 6D.
