Notice of Material Change

Miss Gregoire of Marlborough moves to amend the bill by inserting after SECTION 103 the following section:-

SECTION XX. Section 13(a) of chapter 6D, of the General Laws, as amended by chapter 224 of the acts of 2012, is hereby further amended by inserting after the second paragraph, the following paragraph:-

Every provider or provider organization shall, when submitting a determination of need application under section 25C of chapter 111, submit a copy of such application to the commission.  Within 30 days of receipt of a determination of need application the commission shall conduct a preliminary review to determine whether the proposed project is likely to result in a significant impact on the commonwealth's ability to meet the health care cost growth benchmark, established in section 9, or on the competitive market and shall promptly notify the department of public health of the results of such preliminary review.  If the commission finds that the change is likely to have a significant impact on the commonwealth's ability to meet the health care cost growth benchmark, or on the competitive market, the commission shall conduct a cost and market impact review under this section and shall notify the department of public health of the result of such review.
