Amendment #6 to H3452

Out-of-pocket Protection for Services Provided by Dana-Farber Cancer Institute

Ms. Benson of Lunenburg moves to amend the bill SECTION 104 of H. 3452 is hereby amended by deleting the SECTION and replacing it with the following: --

“SECTION 104.  Sections 2 to 4, inclusive, 6 to 50, inclusive, 52 to 93, inclusive, 95 to 101, inclusive, and 105 shall take effect January 1, 2014.”

Said H. 3452 is hereby further amended by adding the following at the end thereof: --

“SECTION 105.  Notwithstanding any general or special law to the contrary, for any health plan, as defined in section 1301(b)(1) of the Patient Protection and Affordable Care Act, Public Law 111-48, as amended from time to time, and any self-funded group health plan, in each case that is subject to the provisions of section 1301 of said Act, the limitation with respect to non-network providers contained in section 1301(c)(3)(B) of said Act shall not apply to the services of comprehensive cancer centers, as defined in chapter 6D, section 1.”
