Amendment #1 to H3711

Study of Controlled Substance Analogue

Representatives Jones of North Reading, Peterson of Grafton, Hill of Ipswich, Poirier of North Attleborough and deMacedo of Plymouth moves to amend the bill by inserting at the end thereof the following:--

 

"SECTION XX.  The Department of Public Health, and the Executive Office of Public Safety and Security, shall jointly study the feasibility of establishing criminal penalties for the distribution, possession and use of, and the most effective methodology for preserving the public health and safety with regard to, addictive substances that are the subject of an emergency order by the commissioner of public health pursuant to section 2A of chapter 94C of the General Laws.   Said study shall, additionally, make recommendations on the feasibility of establishing criminal penalties for the distribution, possession and use of, and the most effective methodology for preserving the public health and safety with regard to, controlled substance analogues, as defined under 21 U.S.C. section 802.

The results of said study, together with any recommendations, shall be filed with the Clerks of the House and the Senate, the Chairpersons of the Joint Committee on Mental Health and Substance Abuse, and the Chairpersons of the Joint Committee on Public Safety, not later than December 31, 2014.".
