Amendment #241 to H3860

Low Capacity Lifts

Ms. Garlick of Needham moves to amend the bill by adding the following 2 sections:-

“SECTION XX.  The second sentence of the second paragraph of section 65 of chapter 143 of the General Laws, as most recently amended by section 6 of chapter 3 of the acts of 2013, is hereby further amended by inserting after the word “certificate”, the following:-

; provided, however, that if the owner or operator of an elevator is a nonprofit corporation and the elevator has a travel distance of  20 feet or less and holds 750 pounds or less, such owner or operator shall be punished by a fine of $25 for each day that an elevator is in operation without a valid certificate.

SECTION YY. Section XX shall apply to all fines assessed, or any appeal of such fine filed, on or after January 1, 2013.”
