Amendment #59 to H3983

Minimum Wage Exemption When Housing is Provided

Representatives Dooley of Norfolk, Jones of North Reading, Peterson of Grafton, Hill of Ipswich, Poirier of North Attleborough, deMacedo of Plymouth, Frost of Auburn, Howitt of Seekonk, Beaton of Shrewsbury, Cole of Peabody, Lombardo of Billerica, O'Connell of Taunton and Diehl of Whitman moves to amend the bill by inserting, after SECTION 30, the following:--

“SECTION XX.  Section 1 of chapter 151 of the General Laws, as appearing in the 2012 Official Edition, is hereby amended by adding at the end of the first paragraph the following:—

This section shall not apply to workers who are provided housing pursuant to their employment that complies with state and local building code requirements including safety and habitability.  Employers that offer housing as part of the compensation pursuant to an employment agreement may pay a wage up to 33% less than the minimum wage.  When housing is provided to an employee by the employer, any wage less than 67% of the minimum wage, in any occupation, as defined in this chapter, shall conclusively be presumed to be oppressive and unreasonable, wherever the term “minimum wage” is used in this chapter, unless the commissioner has expressly approved or shall expressly approve the establishment and payment of a lesser wage under the provisions of sections seven and nine.”.
