Exemption relative to tipped employees

Representatives Ferrante of Gloucester and Peake of Provincetown moves to amend the bill by inserting after section 39 the following section 39A:

There shall be an exemption from the minimum wage rate for employers that demonstrate through reported wages that all directly tipped employees earn at least two times the minimum wage rate.  Employers choosing this option would need to ensure that their directly tipped employees are earning this higher wage level and would be required to make up any shortfall.

Employers choosing this option shall be exempt from the requirements of sections 37, 38, and 39
