Amendment #1138 to H4000
Protection of Homeless Children - Emergency Assistance
Ms. Decker of Cambridge moves to amend the bill (H. 3400) by adding in item 7004-0101 in section 2 the following new words:-
provided further, that, notwithstanding any general or special law or rule or regulation to the contrary, families in receipt of assistance funded under this item or item 7004-0103 shall not be found in noncompliance based on rules violations that the department has not proven in an individual case pose a threat to the health or safety of persons connected to the emergency assistance program unless and until they have been found to have violated reasonable and uniform rules established by the department on at least two separate occasions and shall not be terminated from the emergency assistance program based in whole or in part on such rules violations unless and until they have been found in noncompliance at least twice; provided further, that such rules violations covered by the preceding proviso shall be excused for good cause reasons, including but not necessarily limited to good cause reasons referenced in 760 CMR 67.06(a)(5).
