Amendment #251 to H4000

MassHealth Pharmacy Dispensing Fee Study

Mr. Cusack of Braintree moves to amend the bill in Section 2 in line item 4000 – 0700 by adding the following:

 

; provided further, that MassHealth shall prepare a report to the House and Senate Committees on Ways and Means on the amount of annual savings to be realized by the MassHealth Pharmacy Program as a result of the proposed adoption of the Federal Upper Limits using Average Manufacturer Price data as required by the Federal rules pursuant to the Patient Protection and Affordable Care Act (P.L. 111-148); provided further, that MassHealth shall conduct a survey in cooperation with retail pharmacies to determine the actual average cost to dispense prescription medications to MassHealth recipients; provided further, that MassHealth shall, prior to the effective date of the adoption of the AMP-based Federal Upper Limit Prices, recommend an increase to the pharmacy dispensing fee  to reflect the true cost of dispensing drugs under the MassHealth Pharmacy Program as determined by said study.
