Further Amendment to #54

Mr. Markey of Dartmouth moves to further amend amendment 54 by inserting the following section:-

SECTION XXA. Notwithstanding any special or general law to the contrary, the provisions of sections XX to XX, inclusive, shall not take effect until such time as the Attorney General provides a written advisory opinion concerning whether denying the right to counsel for indigent petitioners in sex offender registry board proceedings pursuant to sections 178L and 178M of chapter 6 of the General Laws raises constitutional issues.  The opinion shall be filed on or before July 15, 2014, with the clerks of the house of representatives and senate who shall forward the same to the joint committee on the judiciary and the house and senate committees on ways and means.
