Amendment #737 to H4000
Protecting children in DCF care
Representatives O'Connell of Taunton, Cole of Peabody, Diehl of Whitman, Dooley of Norfolk, Kuros of Uxbridge, Fattman of Sutton and Lombardo of Billerica move to amend the bill by adding the following section:-
“SECTION XXXX: Notwithstanding any general or special law to the contrary, all service plans for parents or guardians whose children have been placed in the care and/or custody of the department of children and families due to drug and/or alcohol abuse by the parents or guardians shall require the parents or guardians to submit to random drug and alcohol testing not less than once per month; provided further that parents or guardians with one or more drug or alcohol related convictions submit to treatment and random drug and alcohol testing not less than once per month; provided further that no infant or child shall be placed with a parent or guardian who has failed a drug test. The department shall promulgate rules and procedures to carry out the provisions of this section. This section shall take effect no later than October 31, 2014.”
