Protecting children in DCF care
Mrs. O'Connell of Taunton moves to amend the bill by adding the following section:-
“SECTION XXXX: Notwithstanding any general or special law to the contrary, all service plans for parents or guardians whose children have been placed in the care and custody of the department of children and families due to illegal drug abuse by the parents or guardians shall require the parents or guardians to submit to random drug testing not less than once per month; provided further that no infant or child shall be placed with a parent or guardian who has failed a drug test under the service plan.
All service plans for parents or guardians whose children have been placed in the care and/or custody of the department of children and families due to one or more drug related convictions shall submit to treatment and random drug testing not less than once per month; provided further that no infant or child shall be placed with a parent or guardian who has failed a drug test under the service plan. The department shall promulgate rules and procedures to carry out the provisions of this section. This section shall take effect no later than October 31, 2014.”
