One Person One Vote

Ms. Forry, Ms. Chang-Diaz and Ms. Jehlen move to amend the amendment by inserting at the end of Section 14 the following:-

“(d) Section two of Chapter 54 of the General Laws, as appearing in the 2012 Official Edition is hereby amended by adding the following paragraphs:-

‘Each year in which the federal decennial census is taken, and in which the United States Census Bureau counts the number of incarcerated persons, the Department of Correction shall determine the residential address of all persons committed to the custody of the department and maintain an electronic record thereof.  Such record shall contain, but is not limited to, the last-known residential street address of each person prior to incarceration.

For each person included in the record determined by the Department of Corrections, the Secretary of the State, if such person’s residential address is known, in this state, and not serving a life sentence without the opportunity for parole, shall:

(1) Adjust all relevant population counts reported in the census as if the person resided at that address on the date for which the census reports population; and

(2) Ensure that the person is not represented in any applicable population counts reported in the federal decennial census for the geographic units that include the facility in which the person was incarcerated on the date for which the census reports population.’
