Appeals Process

Mrs. Haddad of Somerset moves to amend the bill by adding the following section:-

SECTION XY. Notwithstanding any general or special law to the contrary, the department of environmental protection shall promulgate regulations establishing an appeals process pursuant to and consistent with the provisions of chapter 30A of the General Laws for the purpose of reviewing decisions made by the department relative to: (1) the classification of a facility under 310 CMR 15.203; and (2) the determination of design flow pursuant to 310 CMR 15.203(6).
