Minimum Term for Felony Murder and 1st Degree Murder

Ms. Spilka, Mr. Barrett, Ms. Chandler, Ms. Creem, Ms. Chang-Diaz, Mr. Eldridge, Ms. Jehlen, Messrs. Lewis, Donnelly and Wolf move to amend the amendment by striking out section 6 and inserting in place thereof the following section:-

"SECTION 6. Section 24 of chapter 279 of the General Laws, as so appearing, is hereby amended by adding the following paragraphs:-

In the case of a sentence to life imprisonment for murder in the first degree with either deliberately premeditated malice aforethought or with extreme atrocity or cruelty committed by a person on or after his fourteenth birthday and before his eighteenth birthday, the court shall fix a minimum term of not less than 18 years nor more than 22 years.

In the case of a sentence to life imprisonment for a murder in the first degree that resulted exclusively from the commission or attempted commission of a crime punishable with death or imprisonment for life committed by a person on or after his fourteenth birthday and before his eighteenth birthday, the court shall fix a minimum term of not less than 15 years nor more than 20 years."
