Amendment 9

Juvenile Retroactivity

Mr. Tarr moves to amend the amendment by striking Section 7 in its entirety and inserting in place thereof the following:-

“SECTION 7. Sections 1, 5 and 6 shall apply to people who are sentenced to life imprisonment in the first degree committed by a person on or after the person’s fourteenth birthday and before the person’s eighteenth birthday regardless of the parole eligibility statute in effect on the date of his or her crime”

Further moves to amend by inserting the following new section:-

“SECTION_.  If any provision or provisions of this act is or are deemed unconstitutional or inoperative by a by a final judgment, order or decree of the Supreme Court of the United State or the Supreme Judicial Court of the Commonwealth, the remain parts of said act shall not be affected thereby”
