Amendment 16

RELATIVE TO SENTENCING

Ms. Creem, Mr. Barrett and Ms. Chang-Diaz move to amend the bill by striking lines 1119 to 1130 in their entirety and inserting in place thereof the following:-

 

“(b) A person convicted of a violation of subsection (a) shall be punished by imprisonment in the state prison for life or for any term of years, but not less than 10 years.  Prosecutions commenced pursuant to this subsection shall neither be continued without a finding nor placed on file.”

 

And by striking lines 1135 to 1146 in their entirety and inserting in place thereof the following:- “(b) A person convicted of a violation of subsection (a) shall be punished by imprisonment in the state prison for not less than 7 years nor more than 20 years.  Prosecutions commenced pursuant to this subsection shall neither be continued without a finding nor placed on file.”
