Relative to Pepper Spray

Mr. Tarr, Ms. Candaras, Messrs. Hedlund, Humason and Ross move to amend the bill by striking in Section 20 lines 362 through 364 in their entirety and inserting in place thereof the following:- "Whoever purchases, possesses or uses self-defense spray in violation of this in a manner that is not in self-defense, or the defense of another shall be punished by a fine of not less than $2,000 nor more than $5,000 or by imprisonment in a house of correction for not less than 6 months nor more than 2 years or both such fine and imprisonment. Whoever, after having been convicted of the crime of improper use of self-defense spray, commits a second and subsequent such crime, shall be punished by a fine of not less than $5,000 nor more than $10,000 or by imprisonment in a house of correction for not less than 2 ½ years nor more than 5 years or both such fine and imprisonment.”
