Amendment #1038 to H3400

Nursing Home Bed Holds

Representatives Hogan of Stow, Ultrino of Malden, Linsky of Natick, DiNatale of Fitchburg, Hecht of Watertown, Brodeur of Melrose, Orrall of Lakeville, Ferguson of Holden, Cusack of Braintree, Khan of Newton, Gifford of Wareham, Keefe of Worcester, Gregoire of Marlborough, Farley-Bouvier of Pittsfield, Dwyer of Woburn, Muratore of Plymouth, Benson of Lunenburg, Fox of Boston, Fernandes of Milford, Ashe of Longmeadow, Peisch of Wellesley, Kafka of Stoughton, Decker of Cambridge, Rogers of Norwood and Day of Stoneham move to amend the bill in Section 2, in item 4000-0640, in line 13, by inserting after the words “the acts of 1996” the following:

 

“provided further, that funds shall be expended in an amount not less than that appropriated in fiscal year 2014 for purposes of reimbursing nursing facilities for up to and including 10 calendar days per medical event. The division shall reimburse the nursing facility for the medical leave of absence, which shall include an observation stay in a hospital in excess of twenty-four hours, at the recipients’ pre-absence rate during the medical leave and upon the residents return. In the event that a nursing facility resident who is a MassHealth recipient leaves the nursing facility for non-medical reasons, the division shall pay to preserve his or her bed in the facility for a period of up to and including 15 days per year;”
