Amendment #1059 to H3400

Billboards

Representatives Hunt of Boston, Straus of Mattapoisett, DuBois of Brockton, Cullinane of Boston, Livingstone of Boston, McMurtry of Dedham, DiNatale of Fitchburg, Ryan of Boston, Rogers of Cambridge, Schmid of Westport, Stanley of Waltham, Cusack of Braintree, Rogers of Norwood, Ayers of Quincy and Sánchez of Boston move that the bill be amended by striking out section 8 and inserting in place thereof the following section:

 

"SECTION 8. Section 3 of Chapter 6C of the General Laws is hereby amended by striking out subsection, in line 247, the work “and”, as so appearing, and by inserting after the word “employees”, in line 276 as so appearing , the following words:- ; and

 

(49) sell, lease or otherwise contract for advertising, including in or on the facilities of the department, provided however that outdoor advertisements shall be subject to local zoning and approval." ; and by adding the following 3 sections:

 

"SECTION XX. Section 29 of chapter 93 of the General Laws, as appearing in the 2012 Official Edition, is hereby amended by inserting after the first sentence the following 2 sentences:-  For the purposes of this section, a public park or reservation shall include a parkway under the jurisdiction of the department of conservation and recreation. Such rules and regulations shall require that said billboards, signs, and other advertising devices: (i) shall not be located within 500 feet of a public park or reservation; (ii) shall not obstruct the view of any location listed on the national register of historic places; (iii) shall be restricted on particular premises as necessary to promote the protection of open space; and (iv) shall be limited in number such that no single person may receive a permit, license or other authorization to construct or maintain more than 100.

 

SECTION XX. Section 32 of said chapter 93, as so appearing, is hereby amended by inserting after the word “way”, in line 6, the following words:- ; provided, however, that sections 29 to 31, inclusive, and section 33 shall apply to the Massachusetts Department of Transportation and the entities under its jurisdiction, including, but not limited to, the Massachusetts Bay Transit Authority.”

 

Section XX  Section 3 of chapter 161A as so appearing, is hereby amended by striking subsection “n” and inserting the following new section “(n) To sell, lease or otherwise contract for advertising in or on the facilities of the authority. Provided however that billboard advertisements be subject to local zoning and approval.".
